Decreasing access to marijuana by alcohol-impaired customers

Recreational marijuana markets appear to be contributing to morbidity and mortality due to polysubstance impaired driving and other harms by selling a social intoxicant (marijuana) to already intoxicated customers. Impairment increases when marijuana is combined with alcohol, making driving particularly risky and also contributing to other injuries and violence. In recreational marijuana markets, deterrence efforts to reduce impaired driving directed at drivers face challenges due to dispute over THC levels in per se laws and lack of valid field sobriety tests.

A team of researchers at Klein Buendel, the Pacific Institute for Research and Evaluation, and NORC at the University of Chicago, is launching a new 5-year research project to study an alternative prevention approach — decrease access to marijuana by alcohol-impaired customers. The goal of this study is to test the effectiveness of a policy and training intervention in the state-licensed recreational marijuana market in a Northwest State, where state law bans sales to apparently-intoxicated customers. It combines policy efforts by state regulators to increase deterrence of the state’s law and motivate store management to comply and training of store personnel in skills to recognize intoxication and refuse sales, using a responsible marijuana vendor online training developed by the research team.

Specific Aims

Aim 1: Conduct pseudo-intoxicated patron (PiP) assessments at state-licensed recreational marijuana stores in the state’s largest metropolitan area in Year 1.

Aim 2: Implement a policy and training (PT) intervention in Year 2 designed to increase compliance with the state law prohibiting sale of recreational marijuana products to apparently-intoxicated customers with a subsample of stores, assigned at random, that intends to: a) make owners/managers of recreational marijuana stores aware of the state’s law prohibiting sales of marijuana to apparently-intoxicated customers, b) increase their risk perception and motivation to comply with this law, and c) train store personnel in skills needed to recognize signs of intoxication in customers and refuse sales.

Aim 3: Compare PT intervention stores to usual and customary policy and training stores in a randomized controlled trial by posttesting state-licensed recreational marijuana stores in the large metro area with PiP assessments for refusal of sales in Year 3.

Aim 4: Estimate impact of the PT intervention on refusal to PiPs by implementing the PT intervention with the remaining stores in Year 3 in a partial cross-over design and assessing state-licensed stores with the PiP protocol in Year 4 and in Year 5.

The research is innovative and high impact by testing one of the first interventions to prevent recreational marijuana sales to apparently-intoxicated customers in one of the first states to ban such sales to reduce the risk of polysubstance impaired driving and other harms. The design allows for reproducibility by using a partial crossover. The PT intervention can be a model intervention to improve compliance with regulations on recreational marijuana sales in other states that have legalized recreational marijuana or that are considering legalization.

Dr. W. Gill Woodall, Klein Buendel Senior Scientist, participated in a panel discussion at the 45th Annual Scientific Meeting of the Research Society on Alcoholism, June 25-29, in Orlando, Florida. He presented data and results from a recent study assessing and training cannabis store personnel in responsible vendor practices. In the wake of a great expansion of recreational cannabis, the prevention of harms related to polysubstance use has gathered attention as well. Specific and effective prevention strategies are needed. One potential approach borrows from alcohol prevention – responsible sales and service.

Regulations in all state recreational cannabis markets prohibit sales of marijuana products to customers under age 21 and in a few markets, sales to intoxicated customers. Using pseudo-patron methods, our team assessed sales to underage-appearing customers in recreational cannabis stores in Colorado and Washington State (175 stores) in 2016-17 and sales to apparently alcohol-intoxicated customers in stores in Colorado, Oregon, and Washington State (150 stores) in 2018.

Refusal of underage-appearing pseudo-patrons were very frequent (92.6%). By comparison, refusal of apparently alcohol-intoxicated pseudo-patrons was infrequent in all three states (11.0%), even though Oregon state law explicitly prohibited it. An online survey of personnel from 59 stores in 2020 explored frequency of sales to these customers. Respondents indicated that underage customers attempted to enter stores frequently (66.1% several/many times) and customers entered stores who were intoxicated by alcohol (40.7%) or marijuana (44.1%). They often refused sales to customers (57.6% several/many times for any reason; 42.4% for being intoxicated). Management support was high for checking IDs (91.5% supported it a lot) but moderate for refusing to sell to customers appearing intoxicated (74.6%).

An online responsible marijuana vendor training created by Dr. Woodall and his collaborators from Klein Buendel and the Prevention Research Center at the Pacific Institute for Research and Evaluation (PIRE) called “Train To Tend,” may have improved refusal to under-age customers at the entrances in stores that used it (trained stores: 65.9%, baseline, 82.5%, 3-month posttest, and 79.9%, 9-month posttest; untrained stores: 82.6%, 83.1%, 84.5% respectively), but did not seem to impact sales to intoxicated customers (intervention: 11.6%, control: 7.6%).

Deterrence due to state regulations or store policy for sales of cannabis products appears to be lower for sales to customers who appear intoxicated than underage customers in these cannabis markets. Training in responsible sales practices alone may not be successful when deterrence is low. Increasing deterrence may depend on regulators actively prioritizing the law to store licensees and monitoring compliance. Improve understanding of how regulatory policy and retail availability affect potential co-use of alcohol and cannabis in the legalized adult-use markets.

The Train To Tend® responsible marijuana vendor (RMV) training research team recently published results from online RMV training on responsible sales for recreational marijuana store personnel as an abstract for the Annals of Behavioral Medicine. The Train To Tend research team is led by Dr. David Buller from Klein Buendel who would have presented the findings at the 41st Annual Meeting and Scientific Sessions of the Society of Behavioral Medicine in San Francisco, had the conference been held as planned.

Recreational marijuana regulations have been designed, in part, to ensure that cannabis products are sold only to adults over the age of 21 who provide state-approved identification (ID). The Train to Tend online RMV training was developed with input from state regulators and recreational marijuana store personnel to train store staff. The training consists of five modules with interactive learning elements that cover state laws, ID checking, health effects of marijuana, driving under the influence, refusal of sales to intoxicated customers, and store processes, such as product labeling and tracking.

A sample of 175 recreational marijuana stores in Colorado and Washington were selected for a randomized controlled trial with sales to pseudo-underage customers. Of the 175 stores, 75 were assigned to the control condition (usual and customary training) and the remaining 100 were given the online RMV training. At baseline, sales of marijuana to pseudo-underage buyers were refused at 93% of 349 visits to stores across the two states. After adjusting for store characteristics, there was no difference in change in refusal rates between treatment groups from baseline, to a 3-month posttest, or a 9-month posttest. For the intervention stores, training uptake was not related to refusal rate and nearly all recreational cannabis stores refused sales to young patrons who failed to produce appropriate ID.

ID Compliance by Recreational Marijuana Stores in Two States

The recreational sale of marijuana has begun in ten U.S. states and seems likely to expand to several others. Only state-licensed stores can sell recreational marijuana products and only persons over age 21 who provide a valid state-approved identification (ID) can enter the stores and purchase marijuana. The age and ID regulations are intended to prevent youth gaining access to recreational marijuana, and it is important to investigate whether these age and ID restrictions are actually working.

Research collaborators from Klein Buendel and the Pacific Institute for Research and Evaluation, measured compliance with age and ID regulations by state-licensed recreational marijuana stores in two states and reported their findings in the Journal of Studies on Alcohol and Drugs. The paper reports assessment of sale refusal rates in a large, diverse sample of stores selling recreational marijuana in the states of Colorado and Washington. The paper’s analyses describe ID checking behavior by store personnel, estimate refusal rates, and explore factors associated with refusal. 

One hundred seventy-five recreational marijuana stores in Colorado and Washington were visited twice by pseudo-buyer assessment teams in September 2016 to April 2017. A young-adult buyer attempted to enter the store and purchase marijuana without showing a state-approved identification. In the second Colorado visit, a buyer aged 18-20 showed an underage driver’s license and attempted to enter the store and purchase marijuana. No cannabis products were actually purchased.

All stores requested an ID. Stores refused buyers in 73.6% of visits at the entrance, 88.3% cumulative before the counter, and 92.6% cumulative by the time of a purchase attempt. Refusal was lower in Washington than in Colorado but it did not differ by buyer protocol. Overall, compliance with laws restricting marijuana sales to individuals 21 or older with a valid ID was high. The authors suggest that compliance in Washington might be improved by having store personnel check IDs at the store entry. Recreational stores may not be selling marijuana directly to youth, although no information was collected on straw purchases. The measures, methods, analyses, results, conclusions, and limitations are detailed in the publication.

Implementation and Effectiveness of an Online Responsible Vendor Training Program for Recreational Marijuana Stores

Since 2012, nine U.S. States and the District of Columbia (DC) have legalized recreational marijuana, and several other states are looking to follow suit in coming years. At the outset of the legalization of recreational marijuana, the U.S. Department of Justice (DOJ) informed these states that they must put robust constraints into place that prevent youth access to marijuana. To accomplish this DOJ objective, Dr. David Buller and Dr. Gill Woodall from Klein Buendel (KB), and their co-authors created Train To Tend, an online responsible marijuana vendor (RMV) training program that aims to provide retail marijuana staff with the knowledge and skills they need in order to sell marijuana responsibly, and keep their communities safe. In a recent e-publication in the Journal of Public Health Management and Practice, the authors report the results of the implementation and evaluation of Train To Tend and what these results could mean for future research and policy.

Train To Tend was created with input from state regulators and local law enforcement personnel, curriculum standards published by the Colorado Marijuana Enforcement Division, interviews with recreational marijuana store personnel (n=15), and usability testing of a prototype training with store personnel (n=19) in Colorado and Washington State. Of all the input from these various stakeholders, retail marijuana store personnel reported that comprehensive training in responsible sales practices was uncommon in the industry. Coupled with the DOJ objective of preventing youth access to marijuana, this finding demonstrated a need for RMV.

Once all stakeholder input was reviewed, Train To Tend was created, and the training ultimately contained five modules: state laws and regulations, ID checking, health effects of marijuana, customer service practices including recognizing intoxicated patrons, and rules of the trade.

In a randomized controlled trial, the training was tested using a random sample of state-licensed recreational marijuana stores (n=225) in Colorado, Oregon, and Washington State. One hundred twenty-five stores were randomly selected to receive Train To Tend, while the remaining 100 stores received the usual and customary training in their state. In total, 420 store employees completed Train To Tend in 2017 and 2018. Pre- and post-training surveys were administered to Train To Tend trainees to gauge their perceptions of self-efficacy toward RMV practices, as well as their ratings of usability for Train To Tend.

Results revealed that the training improved trainees’ ability to check IDs, use their state’s inventory tracking system, and spot intoxicated customers. Also, most trainees felt very confident using the training, rated the training as user-friendly, and thought that the information and skills learned in the training would help keep their communities safe.

Overall, trainees’ improvement in confidence to engage in responsible sales practices, as well as the high levels of usability for Train To Tend they reported, suggests that programs like Train To Tend are feasible and potentially effective at training staff in recreational marijuana markets. In addition, this randomized-controlled trial provides a solid foundation upon which future research into RMV trainings can be built. This type of research is imperative to ensure the safety of customers that live in early-adopting recreational marijuana markets like Colorado, Oregon, and Washington State. By conducting research like this when recreational marijuana legalization is in its early stages, many unforeseen problems can be mitigated before they grow too large, and ultimately the public can be kept safer.
